TERMS AND CONDITIONS

 

General

These Terms and Conditions apply to the usage by You of the Services (as defined below) on the website www.MrBidwin.com.

The Website and the Services are offered by MrBidwin.

MrBidwin in these Terms and Conditions refers to TRIVOR SRL, a company incorporated in Costa Rica, registration number 3102571535, having its registered office at Goicoechea, San José in Costa Rica.

These Terms and Conditions constitute a binding agreement between You and MrBidwin.

MrBidwin is regulated in Costa Rica under the rules and regulations applicable for online services and gaming.

These Terms and Conditions come into force as soon as You register as a user at MrBidwin.com, by doing which You signify that You have read these Terms and Conditions and accept them.

You fully understand and agree to be bound by the terms and conditions contained herein and as they may be amended by us from time to time.

MrBidwin reserves the right to modify the Terms and Conditions and, thus, to amend this agreement between You and MrBidwin at any time with or without notice.

Such amendments will become effective immediately upon being posted on www.MrBidwin.com. It is Your sole responsibility to review this Agreement, in order to remain updated with all amendments each time You use the service.

 

Services

MrBidwin currently provides three types of auction services:

Free Auctions

You may participate in these auctions when you have available Free Bids in your member account. Free bids are provided free of charge by MrBidwin to all members at increments and intervals decided by MrBidwin. Winnings in Free auctions are USD 1 per won auction.

Premium Auctions

In order to participate in Premium auctions you need to purchase premium bids. These are available to buy at the website www.mrbidwin.com, in various packages. The winnings in the Premium auctions are shown in each of these auctions.

Jackpot auctions

You need premium bids to participate in these auctions. The Premium bids are available to purchace at www.mrbidwin.com in various packages. The winnings in a Jackpot auction increase with each placed bid and hence there is no pre determained ammount of the winning. 

The following is valid for all auctions at MrBidwin.com

Bids become valid at the time they are received by MrBidwin.com’s database and our system registrer the bids. Please note that the bids are not valid from the time they are sent from your computer. Under normal circumstances, it will take approximately 1 (one) second for the bid to become valid. It may in unusual cases take longer time. MrBidwin.com is not responsible for this delay and its consequences when this delay is beyond our control. MrBidwin.com is therefore not responsible for technical problems relating to telecommunications traffic such as a failed transmission.

The auctions ends if no bids are received before the time counter has reached zero seconds. The clock, the current bid and bidders are synchronized with MrBidwin.com’s server. In the event of any disruption in the Internet infrastructure, this synchronization may be delayed.

MrBidwin.com can not be held responsible for service outages and disruptions in the internet connection between the user and MrBidwin.com 's servers. MrBidwin.com reserves the right to pause all active auctions and re-open closed auctions, which's outcome was or would be affected by a service outage.

All kind of cooperation is forbidden. The Bidder has the opportunity to participate in all the current auctions. One bid can only apply to one auction..

MrBidwin.com reserves the right to disqualify users and/or bids without the possibility of refund if following occurs;

If a user in the registration process is filling out misleading information.

If two or more bidders cooperate by exchanging information.

If a user uses a username that may be offending to a third party.

If a user of MrBidwin.com do not follow the remaining rules in our terms and conditions.

 

Your account

Registration and opening of Your member account:

In order to use the services, You must first register with MrBidwin.com and open an account (“Member Account”).

MrBidwin has the right to appoint Payment Solution Providers to act, receive and/or pay funds on behalf of MrBidwin.

You are allowed to have only one Member Account. If You attempt to open more than one Member Account, all accounts You try to open may be blocked or closed.

 

Deposits into Your Member Account

You may participate in the auctions for real money, only if You have sufficient bids on Your Member Account for such participation. MrBidwin shall not give You any credit whatsoever for participation in such auctions. You may participate in any free auction as long as you have sufficient ammounts of free bids.

MrBidwin does not grant any credit for the use of its services.

Bids purchased may not be returned. Free bids can neither be converted into paid bids nor money.

 

Payouts

MrBidwin.com will publish won auctions in the members "my vault" under the name "pending payouts"

Won Free Auctions will be paid out atleast once per week and Won Premium and Jackpot Auctions are processed at least every 48 hours. Payments are made to the winners Click2Pay account which is verified by MrBidwin prior to the first payout. In order to verify such an account a purchase of Premium bids from MrBidwin is needed. The verification of the Click2Pay account is a part of the anti fraud measures employed. In the case that the winner has several verified Click2Pay accounts, payment is made to the account from where Premium Bids were purchased most recently.

Won auctions which MrBidwin has not been able to payout due to that the winner does not have a verified Click2Pay account to where MrBidwin can pay out becomes void after 30 days from when the auction closed. The winner can not make any claim and MrBidwin has no obligation to payout after the 30 day period.

On completion of an auction, it is both MrBidwin's, and the winner's responsibility to contribute to the payout is completed.

If Your Member Account is credited with a winning that do not belong to You, the amount will remain property of MrBidwin and the amount will be transferred from Your Member Account. If prior to MrBidwin knowing about the error winnings that do not belong to You have been paid out, the mistakenly paid amount will constitute a debt owed by You to MrBidwin. In the event of an incorrect crediting, You are obliged to notify MrBidwin immediately by email.

MrBidwin will carry out additional verification procedures for any payout exceeding the equivalent of USD 500 and reserves the right to carry such verification procedures in case of lower payouts.

 

Closing Your Member Account

You may close Your account at any time. MrBidwin will however not re-pay any bids in the account at the time of closure.

MrBidwin reserves the right to close Your Member Account should you not follow the Terms and Conditions.

 

Your obligations as a user

You hereby declare and warrant that:

You are over 18 years of age or such higher minimum legal age of majority as stipulated in the laws of jurisdiction applicable to You and, under the laws applicable to You, You are allowed to participate in the Services offered on the Website.

You participate in the Services strictly in Your personal non-professional capacity for recreational and entertainment reasons only;

You participate in the Games on Your own behalf and not on behalf of any other person;

You are not resident in Costa Rica or the U.S.;

All information that You provide to MrBidwin during the term of validity of this agreement is true, complete, and correct, and that You shall immediately notify us of any change of such information;

You are solely responsible for reporting and accounting for any taxes applicable to You under relevant laws for any winnings that You receive from MrBidwin;

All money that You use to buy bids and place into Your Member Account are not tainted with any illegality and, in particular, do not originate form any illegal activity or source;

You understand that by participating in the Services You take the risk of losing money deposited into Your Member Account;

You shall not be involved in any fraudulent, collusive, fixing or other unlawful activity in relation to Your or third parties’ participation in any of the Services and shall not use any software-assisted methods or techniques or hardware devices for Your participation in any of the Services. MrBidwin hereby reserves the right to invalidate or close Your Member Account or invalidate Your participation in a Service in the event of such behaviour;

In relation to Buying Bids and getting winnings paid out into and from Your Member Account, You shall only use credit card and other financial instruments that are valid and lawfully belong to You.

The computer software that we make available to You is owned by MrBidwin and protected by copyright and other intellectual property laws. You may only use the software for Your own personal, recreational uses in accordance with all rules, terms and conditions hereby established and in accordance with all applicable laws, rules and regulations.

The services we provide online should be used in the same manner as similar services in any other setting. This means that users should be courteous to each other and avoid rude or obscene comments.

 

Exclusion at own will

You may at Your discretion choose to exclude Yourself from using the services on the Website. In order to block Your access to the Games You send a email to customer@mrbidwin.com and we will contact you in order to facilitate blocking the service for you. 

Should You opt for self-exclusion in the manners contemplated above then You will not be able to open the account during the exclusion period which is 12 months.

 

Privacy policy

You hereby acknowledge and consent to MrBidwin is processing Your personal data for the purposes of allowing You access and use the Website and in order to allow You to participate in the services and to provide ancillary services to You.

MrBidwin, acts in accordance with EU directives on personal integrity and data security (Directive 95/46/EC and Directive 2002/58/EC). When bidding in our auctions you accept that MrBidwin stores and handles your personal information (such as phone number, e-mail address, bidding information, address, etcetera.)

You have the right to be informed of the information that MrBidwin.com has stored about you. You also have the right to change information and delete information. MrBidwin has the right to market our newsletters as well as send information to our members. A member has the right to decline our newsletter and or information by unsigning them or informing us at customer@MrBidwin.com. MrBidwin reserves the right to publish our winners of the auction by firstname and surname or username.

MrBidwin will only use Your personal data to allow You to participate in the Services and to carry out operations relevant to Your participation in the Services.

MrBidwin shall also process Your personal data for the purposes of carrying out verification procedures in relation to Your participation in the Services.

Your personal data will not be disclosed to third parties, unless such disclosure is necessary for processing of Your requests, such as effecting transactions on Your Member Account, or unless it is required by law. You hereby consent to such disclosures. 

You must promptly inform MrBidwin, by amending Your profile or otherwise, of any changes to information provided by You at the time of registration and opening of Your Member Account.

In order to provide You with an efficient service, MrBidwin and/or its service providers may require to transfer Your personal data from one country to another on world-wide basis. You hereby consent to Your personal data so transferred.

In the processing of Your Member Account and associated transactions, MrBidwin may have recourse to credit rating agencies, fraud detection agencies, anti-money laundering agencies. You hereby consent to such disclosures.

In order to make Your visit to the Websites more user-friendly, to keep track of visits to the Websites and to improve the service, MrBidwin collects a small piece of information sent from Your browser, called a cookie. You can, if You wish, turn off the collection of cookies (please refer to Your browser instructions as to how to do this). You must note, however, that turning off cookies may restrict Your use of the Websites.

If You have a complaint, You can email our customer service: customer@mrbidwin.com

MrBidwin will use best efforts to resolve a reported matter promptly.

If You have a query with regard to any transaction, You may also contact customer@mrbidwin.com with details of the query. We will review any queried or disputed transactions. Our judgement is final.

 

Limitation of liability

You enter the Website and participate in the Services at Your own risk. The Websites and the Services are provided without any warranty whatsoever, whether express or implied.

Without prejudice to the generality of the preceding provision, MrBidwin, its directors, employees, partners, service providers:

do not warrant that the software or the Website is/are fit for their purpose;

do not warrant that the software and Website are free from errors;

do not warrant that the Websites and/or Services will be accessible without interruptions;

shall not be liable for any loss, costs, expenses or damages, whether direct, indirect, special, consequential, incidental or otherwise, arising in relation to Your use of the Websites or Your participation in the Services.

You hereby agree to fully indemnify and hold harmless MrBidwin, its directors, employees, partners, and service providers for any cost, expense, loss, damages, claims and liabilities howsoever caused that may arise in relation to Your use of the Website or participation in the Services.

 

Anti money laundering reporting

MrBidwin complies with the Anti-Money Laundering Act. MrBidwin shall report any suspicious transaction to the relevant competent authorities in Costa Rica.

If You become aware of any suspicious activity relating to any of the Services of the Website, You must report this to MrBidwin immediately.

MrBidwin may suspend, block or close Your Member Account and withhold funds if requested to do so in accordance with the Anti Money Laundering Act.

 

Breaches, penalties and termination

If You breach any provision of these Terms and Conditions or MrBidwin has a reasonable ground to suspect that You have breached them, MrBidwin reserves the right not to open, suspend, close Your Member Account, withhold any bids and pending payouts and apply such funds on account of any damages due by You.

If MrBidwin suspects that You are engaged in illegal or fraudulent activities when using the Website; or in breach of this Agreement; or that You are having problems with creditors or otherwise detrimental to our business, we may freeze or terminate Your account or cancel any bids at our absolute discretion.

You acknowledge that MrBidwin shall be the final decision-maker of whether You have violated MrBidwin’s rules, terms or conditions in a manner that results in MrBidwin’s suspension or permanent barring from participation in our site.

 

Intellectual property

MrBidwin is the sole owner of the trademark MrBidwin and the MrBidwin logo. Any unauthorised use of the MrBidwin trademark and the MrBidwin logo may result in prosecution.

www.MrBidwin.com is the uniform resource locator of MrBidwin and no unauthorised use may be made of this URL on another website or digital platform without our prior written consent.

MrBidwin is the owner or the rightful licensee of the rights to the technology, software and business systems used within this Website.

The contents and structure of MrBidwin´s Website pages are subject to copyright and database right in the name of Trivor SRL. All rights reserved. The copyright in this Website including all text, graphics, code, files and links belongs to MrBidwin and the site may not be reproduced, transmitted or stored in whole or in part without our written consent. Your registration and use of our system does therefore not confer any rights whatsoever to the intellectual property contained in our system.

Links to the Website and any of the pages therein may not be included in any other website without the prior written consent of MrBidwin.

 

Severability

If any provision of these Terms and Conditions is held to be illegal or unenforceable, such provision shall be severed form these Terms and Conditions and all other provisions shall remain in force unaffected by such severance.

 

Assignment

MrBidwin reserves the right to assign or otherwise lawfully transfer this Agreement. You shall not assign or otherwise transfer this Agreement.

 

Entire Agreement and Admissability

This Agreement constitutes the entire agreement between You and MrBidwin with respect to this Website and save in the case of fraud it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between You and MrBidwin with respect to this Website.

A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.

 

Applicable law and jurisdiction

These Terms and Conditions are governed by the Laws of Costa Rica and the parties submit to the jurisdiction of the Costa Rican courts.
